Georgia is not Florida, and most of the advice online is written for Florida
If you have been reading up since the crash, a lot of what you found does not apply in this state. Here is what actually governs a Georgia claim:
- Georgia is an at-fault state. The driver who caused the crash answers for it through their liability coverage. There is no mandatory PIP and no fourteen-day rule the way Florida has.
- The state minimum is 25/50/25 — $25,000 per person and $50,000 per accident for bodily injury, plus $25,000 for property damage. A great many drivers carry exactly that and nothing more.
- MedPay is optional here. If it is on your policy it pays medical bills regardless of fault, which is worth knowing before you assume you have no coverage. Check the declarations page.
- Two years from the date of the accident to file a personal-injury lawsuit, under O.C.G.A. § 9-3-33. That deadline is for filing suit — not for finishing treatment and not for settling.
Why it hurts on day three and not on day one
Adrenaline suppresses pain. That is why so many people give a statement at the scene, drive themselves home and feel more or less fine that night. The neck hides it longest: whiplash typically surfaces somewhere between twenty-four and seventy-two hours later, sometimes as stiffness, sometimes as a headache that starts at the base of the skull and works forward.
Do not wait these out: neck stiffness or pain, a headache that will not lift, dizziness, numbness or tingling into the arms or hands, low-back pain that worsens when you sit, or losing range of motion when you turn your head.
What your file has to contain
Here is the part nobody explains: your recovery and your claim rest on the same document. A thin, vague chart is worth very little. A detailed, dated one carries weight.

A physical exam with objective findings — range of motion, orthopedic and neurological testing, where the pain actually lives.
Diagnosis and plan
What is wrong, how it connects to the mechanism of the crash, and how many visits it is expected to take.

Common questions
How soon after the crash should I be seen?
There is no legal deadline to start treatment, but the longer you wait, the easier it is for an adjuster to argue your pain came from something else. Within 72 hours is ideal. Separately, Georgia gives you two years from the date of the accident to file a personal-injury lawsuit under O.C.G.A. § 9-3-33.
Do I need an attorney before you will see me?

What if my car barely had a scratch?
Bumpers are engineered to absorb impact. Necks are not. Low-speed collisions produce whiplash routinely, and the amount of visible vehicle damage is a poor predictor of what happened to the person inside.
