What if the driver who hit me had no insurance?
Do not write the claim off yet. Georgia requires insurance companies to offer uninsured motorist coverage, and declining it requires a written rejection. If you never signed one, there is a reasonable chance it is sitting on your policy. Pull the declarations page or call your agent.
What if I was partly at fault?
Georgia applies modified comparative negligence. Under 50 percent fault, you can still recover, with the award reduced by your share. At 50 percent or above, you cannot. That is a determination for the case to make, not us — what we do is treat you and put what we find in writing.
Georgia is an at-fault state, not a no-fault state like Florida. No mandatory PIP, no fourteen-day rule. The window to file a personal-injury lawsuit is two years from the date of the accident under O.C.G.A. § 9-3-33 — a deadline for filing suit, not for starting treatment.
